The theme of this session will involve a discussion around tactics deployed in arbitration proceedings that generate inefficiencies in the arbitral process. We will discuss topics such as how these tactics (and their cost implications) are factored into a decision to arbitrate or fund an arbitration, how these tactics can be combated or avoided as counsel or arbitrator, as well as how institutions can play a role in preventing such tactics, including whether introducing appropriate sanctions is a viable solution.
