Can we take the effectiveness of awards obtained in international arbitration proceedings for granted, or should we be concerned about their challenge? And are such awards always effectively recognized and enforceable in other jurisdictions?

The celebrated 75 years old New York Convention, adopted by 172 members states, should provide that foreign arbitral awards are recognized and enforced with consistency, and even harmony. Does it? We will have a closer look at the peculiarities in the three main EU jurisdictions – France, Germany, Italy – and possibly enlarge the discussion to the floor, to see what comes out.
