La Cour de cassation est la plus haute juridiction de l’ordre judiciaire en France.
Elle contrôle la bonne application du droit par les tribunaux et les cours d’appel afin de garantir une interprétation uniforme de la loi sur l’ensemble du territoire. Sans rejuger les faits, la Cour de cassation examine les moyens de droit. Si elle considère qu’ils sont fondés, la juridiction suprême casse la décision attaquée. L’affaire est alors renvoyée devant une nouvelle juridiction, afin d’être réexaminée.
La Cour de cassation comprend 6 chambres ayant chacune des compétences spécifiques. Le contentieux de l’arbitrage est traité par la première chambre civile qui examine notamment sur les pourvois dirigés contre les décisions de la chambre commerciale internationale de la cour d’appel de Paris (CCIP-CA).
Un colloque consacré au droit de l’arbitrage se tiendra le 10 avril 2025 dans la Grande chambre de la Cour, qui a été inaugurée en 1892. C’est dans cette salle d’audience que siège la première chambre civile, mais aussi la plus haute formation de jugement : l’assemblée plénière. Au mois de janvier, les membres de la Cour s’y réunissent lors d’une audience solennelle marquant le début de l’année judiciaire.
The Court of Cassation is the highest court of the judicial system in France.
It oversees the correct application of the law by the lower courts in order to ensure that texts are interpreted in the same way throughout the country. Without reviewing the facts of the case, the Court then examines the challenged decision. If there is indeed an error with the way the law was applied, the decision is quashed and set aside. The case has consequently to be heard again.
The Court of Cassation comprises 6 chambers, each with specific jurisdiction. Arbitration disputes are handled by the first civil division which examines in particular appeals against decisions of the international commercial chamber of the Paris Court of Appeal (ICCP-CA).
A conference devoted to arbitration law will be held on 10 April 2025 in the Grand Chamber of the Court, which was inaugurated in 1892. The first civil division usually sits in this courtroom but it can also host the most senior formation, the plenary session (or Full Court). In January, members of the Court, with members of the legislative and executive branches in attendance, gather here for a formal hearing, which marks the beginning of the judicial year in France.
