Après l’arbitrage, faire face aux sanctions : Risques d’annulation, risques de non-exécution
Les sanctions posent des défis spécifiques dans la procédure arbitrale et elles engendrent par surcroît de nouvelles difficultés une fois la sentence rendue. Il convient d'évaluer dans quelle mesure la jurisprudence récente de la CJUE et de la Cour de cassation française non seulement affecte l’exécution des sentences arbitrales contre les personnes et entités sanctionnées mais également soulève de nouvelles interrogations quant à la prise en compte des risques liés à l’exécution des sentences au stade de la procédure d’annulation. Cette session permettra d’analyser ces évolutions.
