CÓDIGO DE CONDUCTA PARA ÁRBITROS EN LA RESOLUCIÓN DE CONTROVERSIAS INTERNACIONALES EN MATERIA DE INVERSIONES
El 7 de julio de 2023, la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional (CNUDMI o UNCITRAL por sus siglas en inglés) adoptó el Código de Conducta para Árbitros en la Resolución de Controversias Internacionales en materia de Inversiones. Desde abordar las preocupaciones sobre la acumulación de roles (double-hatting) hasta limitar las comunicaciones ex parte, ¿hasta dónde llega el Código? ¿Cómo se relaciona con los códigos de práctica arbitral existentes? ¿Cuál es su conexión con el Código de Conducta para Jueces (adoptado en principio) y cuál es su importancia dentro de la reforma multilateral de la solución de controversias entre inversores y estados?
