Presentation

The avalanche of unilateral economic sanctions imposed by various states against dozens of other states disrupted access to justice, including the access to arbitration. Hundreds of arbitration cases have been suspended pending permissions by certain states to arbitrate. This situation contradicts the spirit of international arbitration, which is an impartial and independent means of dispute resolution founded on the principles of free and equal access to efficient arbitration procedures. It is forecasted that fragmentation of the world community into different economic and political blocks, trade wars, military conflicts and other challenges will continue to disrupt international trade and consequently will affect international arbitration.

To ensure access to justice now and in the future, the Russian Arbitration Association has developed an arbitration protocol permitting the persons who are affected by unilateral economic sanctions to protect their rights under commercial contracts in arbitration.

The ASAP proposes the wording of arbitration clause and other contractual provisions, minimizing a negative effect of sanctions on the parties’ contractual relations.
