The Investor-State Dispute Settlement (ISDS) system is facing a new set of challenges in the era of geopolitical conflicts. States that once focused on protecting outbound investments are now finding themselves in the role of respondents in arbitration. Meanwhile, critical questions of public international law are increasingly at the heart of these disputes. In this panel, we’ll dive into how the ISDS system is evolving in a world marked by geopolitical tensions. We will discuss:

(1) The role of arbitrators in disputes with geopolitical stakes;
(2) The seat of arbitration in a polarized world;
(3) Is ISDS equipped to handle issues of political significance?
