As States grapple with regulatory challenges in strategic sectors, the balance between the legitimate exercise of a State’s sovereign right to regulate and foreign investors’ right to investment protection is at the heart of many investment treaty arbitrations. Through the lens of high-profile ISDS disputes, the panel will discern doctrinal trends and address strategic considerations, offering valuable insights for both host States and investors that have to navigate the increasingly complex legal and regulatory environment in which foreign investments are made today.
