Objective: compare lex arbitri and judicial approaches between France and Italy.
The session will analyse recent divergences and key differences to bear in mind when choosing Paris or Rome as an arbitration seat, including divergences between courts on critical enforcement and annulment issues (such as Italy and France’s approaches to recognition of partially set-aside awards, suspension of enforcement pending set-aside proceedings, the scope of public policy defenses, and challenges based on arbitrator impartiality and independence).
Through analysis of recent case law from the Paris Court of Appeal and the Italian Supreme Court, practitioners will gain practical insights for navigating enforcement strategy across these two essential European jurisdictions.
