The choice of the arbitral seat determines not only which courts have authority to hear set-aside applications, but also the scope and degree of judicial review of the arbitral tribunal’s jurisdiction.
In this panel, leading French and Swiss practitioners will compare how courts at each seat approach annulment proceedings, with particular emphasis on post-award control of jurisdiction in both commercial and investment arbitration. The discussion will highlight key differences, recent developments and practical consequences for parties when selecting France or Switzerland as a seat.
