Access to reliable financial and operational data is central to any valuation exercise. In arbitration, however, key information may be incomplete, fragmented, or controlled by the opposing party, despite the claimant bearing the burden of proof.
Our panel will explore how such asymmetries influence the quantification of damages — and how tribunals and practitioners navigate evidentiary gaps while preserving analytical rigor and procedural fairness.
