This panel will explore how a combination of financial, construction, and legal expertise enables clients to make well-informed strategic decisions at the pre-dispute stage. By examining what an expert would ultimately be able to demonstrate in arbitration, participants will gain insights into defining negotiation positions, setting red lines, and assessing key risks before a dispute arises. The discussion will cover the initial assessment required by external counsel, the critical issues to review, the benefits and potential pitfalls of involving experts early, and the strategic options that emerge from expert analysis and legal advice. The panel will also address the actions clients can take if arbitration becomes unavoidable, providing a comprehensive, 360° perspective on pre-arbitration decision-making.
