K&L Gates vous invite à une discussion avec Maître Louis Degos, bâtonnier élu de l’Ordre des avocats de Paris, et le Professeur Thomas Clay, sur les enjeux et les spécificités de l’« arbitrage » du bâtonnier.
L’article 21 de la loi du 31 décembre 1971 instaure un « arbitrage » du bâtonnier pour les litiges entre avocats liés à l’exercice de leur profession (« la juridiction du bâtonnier »). Ainsi, même en l’absence de consentement exprès, les parties y sont soumises.
Cependant, cet « arbitrage », qui n’en est pas un, n’est pas exclusif : la jurisprudence rappelle que lorsqu’une clause compromissoire a été prévue, elle prime sur la juridiction du bâtonnier. En effet, depuis 2001, en vertu de l’article 2061 du Code civil et de ses rédactions successives, la présence d’une clause compromissoire fait primer l’arbitrage sur la juridiction du bâtonnier.
