Presentation

A l’origine justice sur mesure par excellence, l’arbitrage est devenu aujourd’hui une procédure standardisée au cours de laquelle les conseils des parties usent des mêmes tactiques et stratégies procédurales et pour lesquelles les tribunaux arbitraux apportent des réponses largement prévisibles voire préfabriquées.

Ce passage du « sur-mesure » au « prêt-à-porter » est-il vraiment souhaitable et existe-t-il des mécanismes qui permettraient de réintroduire une dose de personnalisation au sein d’une procédure arbitrale ?
