Limitation of liability provisions are included in nearly every EPC agreement. Claims are often filed that seek to vitiate such provisions, but rarely successful.
Please join King & Spalding to discuss the Reficar v. CB&I case, where the tribunal found a USD $70 million limitation of liability provision in a cost reimbursable contract was unenforceable and awarded Reficar $1 billion in actual damages.
