La conferencia abordará la base jurídica de la responsabilidad del Estado con respecto a los contratos celebrados por sus entidades, desde la perspectiva del derecho contractual y del derecho internacional, ya sea a través de un tratado de promoción de inversiones o del derecho consuetudinario.
Se analizarán los criterios para atribuir la responsabilidad al Estado, el alcance de las obligaciones derivadas de los contratos celebrados por las entidades públicas y las condiciones en las que se puede invocar la responsabilidad del Estado. Asimismo, se abordarán las diferentes instancias competentes para conocer de estos asuntos, ya sean los tribunales nacionales o la jurisdicción arbitral a través de una cláusula de arbitraje de un contrato que comprometa a la entidad pública, del tratado de promoción de inversiones o de la ley nacional de protección de inversiones.
La conferencia reunirá a ponentes de Europa y de América Latina, lo que permitirá analizar estos temas desde una perspectiva de derecho comparado.
Responsibility of the State in relation to contracts with State Entities: European and Latin American perspectives
The conference will delve into the legal basis of State responsibility for contracts with State entities, considering both contract law and international law (investment treaties, customary law) perspectives.
Participants will explore the criteria for attributing responsibility to the State, the extent of obligations arising from public entity contracts, and the conditions under which State responsibility can be invoked.
Furthermore, the various jurisdictional options for resolving these matters will be assessed, including national courts and arbitration tribunals, which derive their authority from contracts, investment treaties, or national investment protection laws.
The conference will bring together speakers from Europe and Latin America, allowing these issues to be addressed from a comparative law perspective.
