L'Afrique est au centre d’une nouvelle ruée vers les minerais stratégiques, indispensables à la transition énergétique mondiale. Mais cette course effrénée s’accompagne d’une explosion des contentieux miniers et énergétiques, exacerbés par des renégociations contractuelles forcées, expropriations déguisées et instabilité réglementaire. Aujourd’hui, les tribunaux d’arbitrage, et en particulier le CIRDI, sont le théâtre d’un afflux sans précédent de litiges impliquant des États africains, révélant des tensions profondes entre souveraineté nationale et protection des investissements étrangers.
Un arbitrage minier et énergétique sous pression : tensions et restructuration

Alors que plusieurs pays africains renégocient leurs accords miniers et pétroliers, la bataille juridique s’intensifie, exposant des rapports de force asymétriques entre États et investisseurs.
Bien que l’évolution des traités miniers et l’introduction de nouvelles dispositions aient permis d’améliorer certains aspects de la gestion des ressources naturelles en Afrique, il reste essentiel d’adresser la question des traités anciens, afin de garantir un système d’arbitrage plus juste, plus flexible et plus respectueux des aspirations des États africains à la durabilité. Comment résoudre efficacement le problème des traités anciens et leur impact sur les mécanismes d’arbitrage minier ? comment les États africains peuvent-ils s’approprier les outils juridiques nécessaires pour gérer efficacement ces contentieux et défendre leurs intérêts ?
Cette conférence réunira décideurs politiques, juristes, investisseurs et experts du secteur extractif pour décrypter les dernières tendances et identifier les pistes de réforme pour un arbitrage plus souverain, équitable et durable.
