New-Generation BITs: Reform, Rebrand, or Reset? is a PAW session examining how “new generation” bilateral investment treaties are evolving—and whether recent changes amount to genuine reform, a rebranding exercise, or a full reset of the investment protection model.
Bringing together perspectives from States, investors, arbitrators, institutions, and counsel, the discussion will unpack key treaty innovations (including sustainability/ESG language, refined substantive protections, transparency, and dispute settlement redesign).
It will also explore whether these new-generation BITs are changing how stakeholders understand and apply key legal standards, and whether that shift is already visible in the reasoning and outcomes of recent cases.
This event is organised in collaboration with PIAG and Young EFILA.
