Dania FAHS
Dr Dania Fahs Nationality: Lebanese - Canadian Current Position: Lawyer and dispute resolution specialist in arbitration, mediation, and integrative negotiation - Lecturer in IP law at Saint Joseph University Dubai Former regional director at ICC International Court Arbitration &ADRs- MENA. Dania has a (19 +) years of mixed experience as attorney in private practice, in-house counseling, and institutional practice with ICC until recently (July 2023). She is specialized in transactional, commercial and IP law and has advised clients on a broad range of commercial contentious and non-contentious matters as well as assisted in negotiating complex cross border transactions in various sectors (pharmaceutical, technology, FMCG, luxury…) Prior to joining ICC, Dania was a senior legal counsel at Oracle Corp. She has an extensive international experience in advising multinational boards on a wide range of legal and strategic issues. A former lecturer in American Business Law (American University of Beirut), and in Intellectual Property Law (La Sagesse University) Dania holds a PhD in Contractual Law (University Montpellier I -France) Dir. Prof. Jacques Raynard and an Executive MBA from INSEAD (2018). She also holds a post graduate micro-programme degree in IP and Alternative Dispute Resolution (University of Montreal). She is certified as Trainer of Trainers by the WIPO Arbitration and Mediation Centre, member of Arbitral Women and a certified CEDR mediator.

Civil law has long set the tone in MENA arbitration. But is it still calling the shots?\r\n

On the occasion of Paris Arbitration Week, this roundtable will offer an open and practice-oriented discussion around a question that increasingly arises in arbitrations involving the MENA region: does civil law still “run the show”?\r\n
\r\n
The discussion will be hosted and moderated by Marie-Laure Bizeau and Caroline Duclercq, who will bring their combined experience as both counsel and arbitrators in MENA-related disputes, and will contribute their practical insights drawn from a wide range of proceedings seated in and involving the region.\r\n
\r\n
The debate will feature Lara Hammoud and Bassam Mirza, both trained in civil law and both having practised (or currently practising) in a MENA jurisdiction. Each speaker will offer a short presentation (approximately 15 minutes), one defending the proposition that civil law still “runs the show” in MENA arbitration, and the other arguing the contrary.\r\n
\r\n
Reflecting both the diversity of practice and the speakers’ respective backgrounds, the session will be conducted in both French and English, without interpretation.\r\n
\r\n
Structured as a roundtable discussion among arbitration practitioners, this session aims to foster genuine exchanges of experience and practical know-how, in an informal, open and interactive, yet rigorous and professional, setting. The floor will then be opened to all participants, who will be invited to share their experiences, ask questions, and discuss practical issues encountered in their own cases, with a view to encouraging frank, experience-based exchanges across generations of arbitration practitioners.\r\n

Dania is a lawyer and senior executive with (20 +) years of mixed experience as attorney in private practice, in-house counseling, and institutional practice (formerly with the ICC International Court of Arbitration- where she held the role of ICC MENA Director). \r\n
She is dual qualified in civil and common law. She is specialized in transactional and commercial law (including IP) and has advised clients on a broad range of commercial contentious and non-contentious matters as well as assisted in negotiating complex cross border transactions in various sectors (pharmaceutical, technology, Energy, FMCG, luxury…). \r\n
Dania holds a PhD in Contractual Law (University Montpellier I -France) and an Executive MBA from INSEAD (2018). She also holds a post graduate degree in IP and Alternative Dispute Resolution (University of Montreal).\r\n
She is a university visiting lecturer in Dispute Resolution, IP law and US Business Law (Saint Joseph University Dubai and the American University of Beirut). She is a member of Arbitral Women and a certified CEDR mediator, and she is on the list of arbitrators and mediators of several regional and international arbitral institutions. \r\n

Bassam Mirza is a France- and Lebanon-qualified lawyer and international arbitrator with over 20 years’ experience in cross-border disputes. He has practised both in Europe and the Middle East, including with leading international law firms and within his own firm, Kecsmar Mirza Arbitration, with experience across sectors such as energy, construction, telecoms and project finance. He previously served as Lebanon’s representative on the ICSID Panel of Conciliators (2016–2022) and as a lecturer in French and Lebanese civil law at Saint Joseph University of Beirut. He is recognised by Who’s Who Legal Arbitration as a leading arbitrator.\r\n
