Karim M'ZIANI
Legal Counsel
Permanent Court of Arbitration
Karim M’ziani is a Legal Counsel at the Permanent Court of Arbitration (PCA), and the Registrar of the Mauritius International Arbitration Centre (MIAC), in Port Louis, Mauritius. Karim completed his law studies in France, China and Argentina. He undertook an LL.M. at Duke University, as a Fulbright scholar. As part of his scholarship, Karim focused his research on international arbitration in Africa. Prior to joining the PCA and MIAC, Karim worked at leading law firms in France, Argentina, and the United States on high profile State-to-State, investor-State, and commercial disputes involving parties from the African continent and beyond. He is admitted to practice in New York and Paris, and speaks English, French, Spanish, and Mandarin. Karim also serves as the Deputy Secretary General of the African Society of International Law.

African States increasingly face international arbitration claims, particularly in the fields of investment, commercial arbitration involving State-owned entities, and treaty-based disputes. The manner in which States respond to the increasing costs burden of such claims is a topic that will be of concern to the round table.\r\n

Drawing on a diverse range of viewpoints, this round table will explore the costs burden of international arbitration on African States. Our panellists will address a range of themes including the costs of arbitration, legal budgets of State defence teams, security for costs, and third-party funding option. This session aims to share practical, experience-based insights on how States can manage efficiently and effectively the costs burden of international arbitration.\r\n

In sum, the round table seeks to:\r\n
1.\tDiscuss the costs burden on States when responding to international arbitration claims;\r\n
2.\tHighlight common institutional, procedural, and strategic challenges faced by government legal offices;\r\n
3.\tDiscuss mechanisms for managing legal budgets between Attorneys-General’s offices, ministries, and external counsel;\r\n
4.\tDiscuss applications for security for costs;\r\n
5.\tDiscuss whether third-party funding may be available for States;\r\n
6.\tPromote peer learning among African government practitioners and arbitration specialists; and\r\n
7.\tContribute to AfSIL’s broader objective of strengthening African capacity and expertise in international dispute resolution.\r\n
