La frontière entre l’arbitrage et le contentieux tend à s’estomper. Ces deux modes de règlement des différends s’influencent mutuellement, chacun empruntant certaines caractéristiques à l’autre tout en préservant son identité propre. Le contentieux connaît un mouvement de contractualisation, offrant aux parties une plus grande liberté dans l’organisation de la procédure, tandis que l’arbitrage s’oriente vers une procéduralisation accrue.
