Presentation
The discussion will provide a comparative law approach to pre and post award issues such as:
- Curative and preventive measures: lis pendens (stay), consolidation, anti-suit injunctions, competence-competence principle, forum non conveniens; and
- Conflicting judgments (including at the stage of review of arbitral awards) and res judicata.
The Q&A will be moderated by Judith Sawang, and will offer perspectives from Germany (Holger Jacobs), France (Claire Debourg), Italy (Giovanni Zarra), Spain (Luis Fernando Rodrigues), UK and Canada (Stephanie Forrest) and India (Kshama Loya).
