L’histoire de l’arbitrage n’est pas une simple succession de normes : elle est une onde longue, une vibration continue où le droit épouse les exigences du commerce. La Loi sur l’arbitrage de 1698, véritable acte fondateur, a insufflé au droit anglais une politique pro-arbitrage visionnaire, érigeant l’autonomie des parties et l’efficacité normative en piliers de la sécurité juridique.
À l’occasion des 60 ans de la CUNDCI et en hommage à Emmanuel Gaillard, l’Académie africaine de théorie du droit réaffirme que l’arbitrage n’est pas seulement un instrument de règlement des différends, mais un espace de réflexion philosophique, théorique et stratégique. Héritier d’une longue tradition humaniste, il renaît tel le phénix face aux pressions du marché et de la technique, affirmant la force de la clause fondée sur l’autonomie de la volonté.
