Matthias FEKL
Matthias Fekl co-founded Audit Duprey Fekl law firm and the international mediation platform Equanim International.
Matthias Fekl's practice focuses on both advisory and litigation matters, particularly in public law, investment projects and alternative dispute resolution. He regularly acts as a mediator or as counsel in mediations. He has always expressed a strong interest in arbitration, including through his strong support of ambitious reforms in investment arbitration. Matthias Fekl has a deep understanding of the functioning of the French economic fabric and of public and private decision-making processes at all levels: local, national, European and international. He assists SMEs, mid-sized corporations and large groups alike with their projects as well as in their litigations.
Matthias Fekl is a board member of the French Committee of the International Chamber of Commerce (ICC France). He is also a board member and contributes to the promotion of Paris City of Law – Paris – Place de droit -, where he leads the committee for “attractiveness,” in charge of all matters related to Paris’ and France’s attractiveness as major players in the field of law, litigation and legal influence.
Prior to founding Audit Duprey Fekl, Matthias Fek Fekl served as Minister for the Interior (Home Secretary), Secretary of State for Foreign Trade, Promotion of Tourism and French Nationals Abroad, and Member of Parliament, where he was Member of the Law Commission of the National Assembly.

The recent spike in the number of investment arbitrations and the growing dissatisfaction with the ISDS system in general have led certain States to amend, suspend or terminate their BITs and other investment promotion instruments to avoid further liability.\r\n
\r\n
As of the late 2010s, Bolivia, Ecuador, South Africa, India, Indonesia and Venezuela – to name a few – decided to terminate some or all of their BITs. Bolivia, Venezuela and Ecuador went even further, denouncing the ICSID Convention. The wind has blown over Europe too. In the context of the Achmea and Komstroy saga, several EU Member States recently withdrew from the Energy Charter Treaty, suddenly halting the ECT’s modernization process. The European Commission has recently proposed a collective and coordinated exit of all 27 EU Member States. \r\n
\r\n
This has shed new light on several post-termination liability mechanisms, the first of which being the so-called “sunset” or “survival” clause. This tool extends investment protection beyond the termination of a treaty for an additional period of time and thus prolongs the State’s exposure to potential arbitration claims. While ensuring the protection of investors’ legitimate expectations, it also added grist to the mill of investment arbitration critics and fueled the ongoing debate on ISDS legitimacy. \r\n

Amidst growing awareness regarding the challenges to investment arbitration, investor-State mediation (ISM) has recently come into the spotlight as a promising venue for investor-State dispute settlement (ISDS).\r\n
