Sarra SAÏDI
International Arbitration and Sports Lawyer
Sarra Saïdi is an attorney admitted to the Paris Bar and a Barrister & Solicitor member of the Law Society of Ontario. She is an associate at the Paris office of K&L Gates, where she focuses on commercial litigation and international arbitration, advising French and international companies on pre-litigation and litigation matters across various industries. She also specializes in sports law in Canada and France, covering various topics such as non-selection, doping, and non-accidental violence.
As part of her pro bono work, Sarra Saïdi represents sports participants before the Sport Dispute Resolution Centre of Canada and serves as a specialized legal advisor for the Abuse-Free Sport Legal Aid Program, supporting the Office of the Sport Integrity Commissioner.
She is a member of several independent disciplinary bodies within sports federations, addressing safe sport issues, including World Sailing Safeguarding Disciplinary Tribunal and the Special Committee on Gender-Based and Sexual Violence, Harassment, and Discrimination at the French Baseball and Softball Federation.
Additionally, she serves on the appeal disciplinary commission of the French Athletics Federation and the French Triathlon Federation. She is also a member of the Alpine Independent Supervisory Board of Alpine Canada, which is empowered to adjudicate major infractions.

<b>Le CRDSC, modèle au service de la démocratie sportive</b>\r\n

K&L Gates France a l'honneur d'accueillir Marie-Claude Asselin, directrice générale du Centre de Règlement des Différends Sportifs du Canada (CRDSC), lors de la Paris Arbitration Week 2024.\r\n
\r\n
2024 correspond à une année anniversaire pour la France et le Canada. La France accueille les Jeux Olympiques, cent ans après la première édition, tandis que le Canada célèbre les 20 ans du CRDSC, une institution qui a profondément modifié la culture du sport canadien.\r\n
\r\n
À cet égard, nous sommes ravis d'organiser une discussion avec Marie-Claude Asselin autour de l'arbitrage sportif. Au fil des ans, elle est devenue l'ambassadrice d'un centre d'arbitrage sportif national, véritable source d'inspiration en termes de gouvernance sportive pour de nombreux pays.\r\n
\r\n
Le modèle de démocratie sportive du CRDSC est matérialisé par son conseil d’administration avec une représentation des athlètes, des entraîneurs et des organisations sportives permettant de définir une stratégie à long terme, de manière collégiale, et qui sert le sport canadien de manière générale. \r\n
\r\n
<b>Indépendance</b>\r\n
\r\n
Né en 2003 avec la Loi favorisant l'activité physique et le sport (L.C. 2003, ch. 2), le CRDSC est officiellement inauguré à Montréal en avril 2004, avec une mission : « <i>fournir à la communauté sportive un service pancanadien de règlement extrajudiciaire des différends sportifs ainsi qu'une expertise et une assistance en la matière.</i> »\r\n
\r\n
Le CRDSC est constitué sous la forme d’une organisation à but non lucratif, financée principalement par Sport Canada, un service gouvernemental chargé de promouvoir le sport amateur et de haut niveau. Le CRDSC est à ce titre complètement indépendant du Comité olympique canadien.\r\n
\r\n
Les processus de règlement extrajudiciaire des différends comprennent la prévention, la négociation, la facilitation, la médiation et l'arbitrage. Leurs objectifs visent à réduire les délais et les coûts du règlement des différends, à préserver ou améliorer les relations entre les parties, à assurer des solutions concrètes, applicables et durables, ainsi qu'à permettre aux parties de comprendre les enjeux d’un tel processus.\r\n
\r\n
<b>Modèle de transparence</b>\r\n
\r\n
Le CRDSC fonctionne autour de deux piliers principaux : son Secrétariat de règlement des différends (tribunal) mais surtout son Centre de ressources pour la prévention des différends.\r\n
\r\n
Dès sa création, le CRDSC place la transparence au cœur de son action à travers son Centre de ressources pour la prévention des différends, conçu comme une bibliothèque juridique spécialisée en droit du sport. Ses objectifs sont multiples : prévenir les différends, accélérer le règlement des litiges et promouvoir une compréhension approfondie des droits et des responsabilités des principaux acteurs du domaine sportif.\r\n
\r\n
La variété des ressources disponibles et la base de données jurisprudentielle du CRDSC sont des éléments essentiels pour les avocats qui aident les athlètes et les autres parties prenantes du sport. Elles améliorent leur accès à l'information, ce qui est primordial lors de procédures souvent rapides et décisives lors de procédures accélérées (non-sélection, dopage, etc.).\r\n
\r\n
<b>Un accès à la justice sportive facilité</b>\r\n
\r\n
Le site Internet du CRDSC publie une liste d’arbitre, mais également d’avocats spécialisés en droit du sport pour faciliter l’accès à la justice sportive, y compris un programme <i>pro bono</i>, offrant ainsi un accompagnement gratuit aux parties qui en font la demande. \r\n
\r\n
C’est dans le cadre de cette initiative que notre collaboratrice, Me Sarra Saïdi, avocate inscrite aux barreaux de Paris et de l'Ontario, offre régulièrement son assistance à des athlètes engagés dans des procédures devant le CRDSC. Témoin privilégiée de ce système, elle constate les bénéfices que cette aide juridique procure aux athlètes, leur offrant une assistance pour naviguer les procédures de la justice sportive.\r\n
\r\n
<b>Pionnier sur le <i>safe sport</i></b>\r\n
\r\n
En mars 2016, le CRDSC, s'est positionné en tant première institution sportive au monde à entreprendre une réflexion publique sur le consensus du Comité International Olympique sur les violences non accidentelles qui consacrait la notion de <i>safe sport</i>. Avant même l'émergence du mouvement #MeToo ou la création de l'<i>U.S. Center for SafeSport</i>, le CRDSC recherchait auprès d’experts et de chercheurs universitaires le moyen d’être un moteur du changement au service d’une pratique sportive sans abus. \r\n
\r\n
Ce leadership sera reconnu par le gouvernement canadien, qui choisira le CRDSC en 2021 pour mettre en place un mécanisme indépendant dédié au <i>safe sport</i>. Cela aboutira à la création d'une division autonome au sein du centre, nommée le Bureau du Commissaire à l'intégrité dans le sport, ainsi qu'au lancement du programme « Sport Sans Abus » en 2022.\r\n

En février 2023, le quotidien sportif <i>L’Équipe</i> adoptait une approche de journalisme de solutions en rassemblant des personnalités « <i>qualifiées</i> » pour discuter de la crise de gouvernance sans précédent que traverse le sport français. L’une des questions soumises à la discussion par le directeur de la rédaction du journal visait les fédérations sportives : « <i>Doit-on créer une autorité indépendante qui permette de ne pas les laisser continuer à régler leurs ‘affaires’ ‘en famille’ ?</i>». De cette rencontre, un « <i>SafeSport français</i> » faisait l’unanimité, reprenant l’orthographe de l’institution américaine <i>U.S. Center for SafeSport</i>, une institution indépendante du Comité olympique et paralympique des États-Unis, et qui soumet à l’arbitrage les litiges disciplinaires en violation de la liste des conduites interdites de son Code SafeSport.\r\n
\r\n
Un « <i>SafeSport français</i> » nécessiterait la mise en place d'une autorité publique indépendante, dotée de la personnalité morale, à l'image de l'Agence française de lutte contre le dopage, cette dernière étant structurée ainsi pour être en conformité avec le Code mondial antidopage.\r\n
\r\n
À l’heure où de nombreux chercheurs internationaux ont lancé une pétition depuis Bruxelles appelant à l’organisation d’une conférence internationale sur les violences dans le sport, similaire à ce qui avait précédé la création de l’Agence mondiale antidopage (AMA), il n’est pas exclu qu’une instance mondiale du <i>safe sport</i> puisse voir le jour. Elle pourrait agir comme un moyen global et coordonné pour mettre en conformité les pays n’ayant pas (ou ne voulant pas) de structures indépendantes dédiées à la lutte contre les violences en milieu sportif.\r\n
\r\n
\r\n
<b>Le <i>safe sport</i>, un droit fondamental</b>\r\n
\r\n
Le concept de <i>safe sport</i>, est étroitement lié aux droits de l’homme en ce qu’il consacre le droit des athlètes à pratiquer leur sport dans un environnement exempt de toute forme de violence non accidentelle, et fait l’objet d’un consensus publié par le Comité International Olympique (CIO) depuis 2016. \r\n
\r\n
Si ce concept est absent des réflexions actuelles en France, au Canada, une initiative de <i>safe sport</i> a été lancée en 2022 avec la mise en place du Bureau du Commissaire à l’intégrité dans le sport (BCIS) chargé de traiter les litiges disciplinaires liés au <i>safe sport</i>, en particulier dans le cadre des plaintes relatives aux violations présumées du Code de conduite universel pour prévenir et contrer la maltraitance dans le sport (CCUMS). \r\n
\r\n
C’est dans la recherche universitaire sur les violences que le CCUMS prend racine, cultivé par une génération de chercheurs persuadée qu’il est nécessaire de décloisonner les disciplines pour mieux informer les décideurs politiques, les institutions sportives et surtout les athlètes. C’est ainsi qu’une liste de « <i>comportements prohibés</i> » est définie sans ambiguïté dans le CCUMS, sur le modèle du Code de l’AMA et de sa « <i>liste des interdictions</i> ».\r\n
\r\n
À cet égard, les travaux de recherche de la Professeure Sylvie Parent sur la prévalence de la violence en milieu sportif sont importants, en particulier à la lumière des récents efforts entrepris en France pour remédier à la crise de gouvernance révélée dans le sillage du témoignage de Sarah Abitbol, ancienne championne de patinage artistique.\r\n
\r\n
\r\n
<b>La Professeure Sylvie Parent, une figure incontournable</b>\r\n
\r\n
Titulaire de la Chaire de recherche Sécurité et Intégrité en milieu sportif à l’Université Laval au Canada, elle est à la tête d’une constellation de chercheurs de divers horizons disciplinaires qui offrent un éclairage crucial sur la violence en milieu sportif.\r\n
\r\n
Son engagement de terrain, couplé à ses recherches trouvent une résonance au Canada, auprès du Conseil de l’Europe mais surtout au sein des institutions faîtières du sport mondial, dont le CIO. De plus, elle partage son expertise auprès d’organisations comme <i>Safe Sport International</i>, permettant de disséminer un savoir essentiel sur la manifestation de la violence interpersonnelle.\r\n
\r\n
Dans un contexte où la parole des athlètes se libère, l’arbitrage est devenu le mode de résolution privilégié des litiges disciplinaires liés aux quatre formes de violences interpersonnelles (physiques, psychologiques, sexuelles et de négligences) dans les pays de l’OCDE. La France fait figure d’exception avec une gestion des litiges disciplinaires « <i>en famille</i> », et où le concept de <i>safe sport</i> est peu mobilisé. \r\n
\r\n
\r\n
<b>France-Canada : regards croisés sur le <i>safe sport</i></b>\r\n
\r\n
